CBS, Wash Post: Obama nominates Lesbian Homosexual Elena Kagan to Supreme Court

CBS News reported that President Obama's new Supreme Court nominee Elena Kagan will be the "first openly gay justice," pleasing much of Obama's liberal base.  But after complaints by an anonymous White House staffer that parts of the report were not public, the CBS reporter updated the post to say "I have to correct my text here to say that Kagan is apparently still closeted -- odd, because her female partner is rather well known in Harvard circles."  The CBS report has now been pulled, after The Washington Post repeated the CBS report, and the White House denials, but criticized CBS policy, saying "most major news organizations have policies against 'outing' gays or reporting on the sex lives of public officials unless they are related to their public duties."  The sudden media blackout on the 'taboo topic' is ironic, since Kagan's private sex life already has, and will directly impact her public Supreme Court decisions.

 
Regardless, The Daily Caller confirms Kagan's policy record reflects extremist sexual views in matters of law:

"Kagan's boldest foray into public life was, as dean of Harvard Law School, throwing the military off campus over its 'don't ask, don't tell' policy on gay soldiers. Kagan called the policy, implemented by her former boss President Bill Clinton, 'a profound wrong — a moral injustice of the first order.'  She pursued the matter all the way to the Supreme Court, where the justices unanimously slapped down her arguments, forcing Harvard to allow the military to return....

"On the Defense of Marriage Act, Kagan damned with faint praise — she defended the law, but not without first saying the Obama administration opposed it, thought it was discriminatory and hoped to overturn it.  Pro-homosexual marriage lawyer Dale Carpenter wrote the move was a 'gift to the gay-marriage movement' because the administration was 'helping knock out a leg from under the opposition to gay marriage.'...

"Long ago, Kagan wrote a memo while clerking for the late Supreme Court Justice Thurgood Marshall that said religious organizations that provide care for teen pregnancies shouldn't get federal funds because of a strict line separating church and state."

Needless to say, Kagan is a bomb-thrower, who would rule as a pro-homosexual, pro-abortion, anti-Christian activist, and she must be filibustered if nominated.

The Wall Street Journal reports Kagan has worked in elite legal and policy jobs but has never served as a judge, which an administration official confirmed Sunday.

"Opponents of her nomination are certain to raise questions about her decision, as Harvard law dean, to sign a friend-of-the-court brief arguing that law schools did not have to allow the U.S. military to recruit on campus because the don't-ask, don't-tell policy barred gays [and lesbians] from serving openly," said WSJ.

"She and other law deans argued the rule violated their antidiscrimination policies, and Ms. Kagan called the policy 'profoundly wrong.' But they were overruled by a unanimous Supreme Court."  If Kagan has served on the court, that ruling would have been 8-1, not 9-0, because Kagan's views of the law on sexuality are far outside the mainstream, regardless of her personal practice.

Kagan is the most extreme of all 7 nominees considered by Obama, we said last month.  



LifeNews.com now reports Kagan is an ardent pro-abortion advocate who, at 50, would leave a pro-abortion legacy for Obama on the Supreme Court for decades to come. She would confirm the suspicion of many political observers that Obama decided to go with a radical left-wing nominee while Democrats control the Senate with a huge advantage that is expected to deteriorate after the November elections.

Senate Republicans have already promised a tough fight against Kagan.

"Our nation deserves a Supreme Court nominee who is committed to deciding cases impartially based on the law, not on personal politics, preferences, or what’s in the nominee’s 'heart,'" Sen. John Cornyn, a pro-life Texas Republican who is a member of the Senate Judiciary Committee, said last month.

The current high court has a 5-4 split in favor of unlimited abortions via Roe v. Wade and Kagan would be expected to continue that.

The ACLU credited Kagan with "shaping Clinton’s policy on hate crimes."  

Wendy Wright, the president of Concerned Women for America, previously said Kagan advocated abortion, and "treated pro-life activists like violent criminals, creating a task force in the Department of Justice and a grand jury to investigate peaceful pro-lifers. This raises serious concerns that she shares the hostile view that religious beliefs are a form of 'hate,'" Wright said.


"Abortion groups are actively attempting to create the impression that international norms require countries to provide access to abortion. During Kagan’s nomination hearing for Solicitor General, Senator Specter questioned her about the use of foreign sources of law in constitutional decision-making," Wright said.

Kagan said before: "At least some members of the Court find foreign law relevant in at least some contexts. When this is the case, I think the Solicitor General's office should offer reasonable foreign law arguments to attract these Justices' support for the positions that the office is taking."

Kagan has also come under criticism from Marjorie Dannenfelser, the president of the pro-life women's group Susan B. Anthony List, who told LifeNews.com, "In the past Kagan has been a strong supporter of the pro-abortion agenda. She has vigorously opposed the de-funding of taxpayer-funded clinics which promote abortions, despite the fact that a majority of Americans do not want their tax dollars to fund abortion providers."

Dear Ameritianity,

The worst kept secret in Washington seemed to be who President Obama would nominate to the Supreme Court. In his official announcement nominating her for the nation's highest court the President called Elena Kagan one of our "nation's foremost legal minds," and a "superb solicitor general." Her known record speaks otherwise.

She has the least amount of experience of any nominee in the last three decades. Her judicial experience is zero, as is her real-world experience, having spent most of her career in academia or working as a Democratic Party insider. (She did serve on an advisory committee for Goldman Sachs during the financial meltdown of 2007!)

Her tenure as Dean of Harvard Law School is marked by kicking the military off campus during the height of the Iraq War, a move that even Ruth Bader Ginsburg ruled was wrong-headed. Ms. Kagan's incredibly hostile view of the military suggests she is out of touch with mainstream sensibilities and obedience to the rule of law.

Recently, in her brief tenure as Solicitor General, she argued that the federal government has the power, under campaign finance laws, to ban certain books and pamphlets. Responding to this argument of Ms. Kagan, Chief Justice John Roberts wrote, "As a free-floating test for First Amendment coverage, that (proposition) is startling and dangerous."

Ms. Kagan has called for the Senate to use the Supreme Court confirmation hearings "to engage nominees in meaningful discussion of legal issues," and that a nominee's views on issues are fair game to be discussed. She should be evaluated by the U.S. Senate with the very standards she set for this process.

During her confirmation hearings for Solicitor General, Ms. Kagan found it difficult to be forthcoming with her answers. That should not be permitted when she is considered for a permanent position on our nation's highest court.

Let your Senators know that Elena Kagan needs to fully answer the many questions people have regarding her record.

Please ask your Senators to thoroughly examine the qualifications of President Obama's Supreme Court Nominee Elena Kagan.

Ivy Leaguer Kagan Not Close to Mainstream America

The magnificent author and son of the Great Santini, Pat Conroy, began "The Prince of Tides," with these words: "My wound is geography. It is also my anchorage, my port of call."

Those 13 words imprinted on my brain when I first read them years ago and have stuck with me.

Somewhat oddly, they came to mind a few days ago upon the nomination of Elena Kagan to the U.S. Supreme Court.

Much has been made of Kagan's career path and her professional trailblazing. Despite a lack of any judicial experience, she is the first of her sex in two previously male-dominated domains — first female dean of Harvard Law School and first female U.S. solicitor general.

No small accomplishments. But though we are what we do, what we do is not all of what we are. We are also products of place. Where we grew up and how we experienced the physical environment of our formation are also a part of who we are.

What is Kagan's geography? What is her anchorage, her port of call?
Coincidentally, she shares the same hometown as the other two women on the court.

Assuming Kagan is confirmed, all three women will hail from New York City. Kagan grew up on the Upper West Side of Manhattan, Sonia Sotomayor is from the Bronx, and Ruth Bader Ginsburg is from Brooklyn.

If diversity on the court is our goal, we may be missing a region or two.

These facts ultimately may be more anecdotally interesting than significant in terms of how a judge might perform. Then again, spending one's formative years walking past the infamously crime-riddled "Murder Hotel" en route to school, as Kagan did — and, say, walking past the First Baptist Church to ballet class — are not the same cultural marinade.

The latter hypothetical is proffered only for the sake of contrast and metaphor. It seems remote to unlikely that a woman whose life has involved Baptist churches and ballet slippers would find herself on a track to today's Supreme Court, though that ought not to be the case.

Women are not of one cloth. (As a footnote, retired Justice Sandra Day O'Connor grew up between El Paso, Texas, and an Arizona ranch and is a famously good dancer.)

Both current female justices and Kagan also attended Ivy League schools, not that there's anything wrong with that. But does a gender-mixed court featuring Kagan, Sotomayor and Ginsburg qualify as a diverse court because they are women? Or do these three represent ideological purity in a lace bib?

The jury is still out.

President Obama has made clear his desire to nominate justices who are in touch with "ordinary Americans." He specifically mentioned "empathy" in choosing Sotomayor.

Before Kagan's nomination, Obama said he wanted someone with a "keen understanding of how the law affects the daily lives of the American people." He wanted a justice who, like retiring John Paul Stevens, "knows that in a democracy, powerful interests must not be allowed to drown out the voices of ordinary citizens."

Enter Kagan?

Certainly New York City dwellers would argue that they struggle with ordinary concerns, just in a more densely arranged environment. But New York, like other urban areas, tends to be more liberal than the vast rest of the country.

More than half the country also happens to be Protestant, yet with Kagan, the court will feature three Jews, six Catholics, and nary a Protestant.

Fewer than one-fourth of Americans are Catholic and 1.7 percent are Jewish.

One does not have to be from a rural Georgia backwater (Clarence Thomas), or the child of recently arrived immigrants (Antonin Scalia and Samuel Alito), to qualify as a justice, though it might help in claiming identity with ordinary people. One could even argue that it matters only that one regard the law with utter neutrality.

But the president adheres to the ordinary-people principle, and so the question must be asked: Does Kagan meet the standard?

She may have other qualifications, including her willingness at Harvard to invite conservative scholars to her faculty. But a New York City girl who attended a prep school, Ivy League colleges and law school, who once barred military recruiters from Harvard's recruitment office and was an adviser to Goldman Sachs, can't be characterized as anything close to mainstream America.

Either Obama may want to tweak his operating narrative or geography may well be Kagan's wound.
